Mrs C presented to the Defendant initially suffering with pain from an infection. Alongside this, Mrs C suffered from Temporo-Mandibular Disorder (TMD), a chronic condition that can cause severe pain and migraines.
The Defendant failed to inform Mrs C of the extent of the infection, and failed to prioritise treatment of the infected tooth. The Defendant inappropriately commenced orthodontic treatment despite the presence of an infection. This caused unnecessary pain as the negligence allowed the infection to progress to a chronic infection requiring antibiotics.
Additionally, the Defendant provided misleading guidance surrounding TMD disorders, and advised the orthodontic treatment would help with the TMD symptoms, when in fact, it worsened Mrs C’s TMD symptoms.
Mrs C’s claim was successful and the damages won have helped pay for the corrective endodontic treatment the infected tooth required, and towards management of the TMD symptoms.
