What Our Clients Say

Establishing A Dental Negligence Claim

In order to establish a dental negligence claim the test is to demonstrate that the treatment or care you received fell below acceptable or reasonable standards expected from a practitioner

Whilst there is not a defined set of rules determining reasonableness, a general guideline is whether in similar circumstances another practitioner would have offered the same advice or treatment

It is necessary to prove that the negligence of a practitioner directly caused injury or resulted in a worse outcome. The legal requirement is to demonstrate that if the negligent act had not occurred you would not have been suffered injury or been worse off.

    Dental Negligence FAQ’s

We deal with a wide and varied range of cases, read on to learn about the types of dental negligence cases we bring on behalf of our clients.

Periodontal or gum disease often goes undetected, with the early symptoms being difficult to identify or missed entirely. The condition however is preventable and easily treatable if detected early enough – hence why it is crucial that your dentist checks for the signs of undiagnosed gum disease regularly through examinations Basic Periodontal Examination (BPE). Most of the claims we deal with are when dentists have left periodontal diseases untreated, this can have serious consequences including the loss of multiple teeth and damage to the supporting jawbone.

Root canals are one of the most common dental negligence cases we deal with. Most of these cases stem from poor cleaning and failure to address infection, this can result in tooth breakage and unnecessary root canal treatment. Most of the legal claims we bring on behalf of our clients relate to infection in the teeth or gums, the dental instruments breakage and root canal perforations due to overfilling or too much pressure.

Most dental work impacts the nerves, this can cause a considerable amount of pain and result in difficulty speaking, chewing, and swallowing. In more extreme cases, patients have permanently lost their sense of feeling in the tongue or mouth, this damage may be irreparable and devastating. Permanent nerve damage is one of the more extreme cases of negligence we deal with, this type of negligence can lead to a substantial claim for compensation.

We deal with a range of tooth extraction issues. Many of the claims we bring are where healthy teeth have been damaged or removed because of negligence, in these cases often extraction was unnecessary or avoidable. In some instances, dentists have extracted the wrong tooth entirely or damage has been sustained to neighbouring teeth.

Treatments for malocclusion, or misaligned teeth come under the branch of orthodontics. The aim is to improve the appearance of positioning of teeth to treat crowded or crooked teeth, teeth that are spaced apart, address bite issues or jaw misalignment. We deal with cases where there are no signs of improvement, malocclusion has occurred post treatment, root resorption issues and cases where there has been resulting damage to the teeth or gums following treatment.

We deal with a range of dental implant claims, implantology procedures can be invasive, complicated, and costly treatments. The procedure is very personalised and requires commitment, it is carried out procedurally and is often a lengthy process. We deal with many cases where implants have not been secured correctly or where underlying problems or infection have weakened or affected the viability of the implant. In some cases, we have discovered that implants were not even necessary

The treatment is usually focused on visible teeth at the front of the mouth. If this treatment goes wrong however, it can be aesthetically displeasing, costly to rectify, painful and even affect eating and speech. Most of the cases we deal with relating to veneers are when the anticipated aesthetic outcome is not achieved or where the treatment has compromised and impacted the health of the affected teeth.

Composite bonding is a common treatment for changing the shape or colour of your teeth, it can also be applied to chipped or fractured teeth and address diastemas – small gaps between your front teeth. The treatment is often advertised as a smile makeover, no drilling is required and therefore it is described as none-invasive, simple and reversible. Most of cases we deal with relate to failed bonds, where the composite filling may have chipped or fallen off. This usually occurs where the tooth was not isolated and prepared correctly before placement.
