What Our Clients Say

The Rise of Cosmetic Practices

Over the years there has been a considerable rise in cosmetic practices. Some procedures are misleadingly and incorrectly marketed as straightforward and superficial, when in fact they are invasive surgical procedures that should not be undertaken without being fully informed.

As with all surgical procedures, there is a great deal to consider before electing to undergo surgery. All clinical practitioners owe their patients a duty of care, and they must obtain informed consent before promoting or undertaking any treatment.

Unfortunately with the informality and casual accessibility in which a great deal of cosmetic surgery is now offered and with the absence of stringent oversight and regulation of providers, many under-qualified and less scrupulous practitioners are offering treatment, with disappointing and often devastating results for clients.

Establishing a Claim for Cosmetic Surgery

Every case and client experience is unique, however our experienced team at Alderman Solicitors is adept in identifying particular issues that can provide grounds in establishing the basis for cosmetic negligence claims.

These many include, but are not limited to, clinicians advising on inappropriate treatments or surgery, not advising on all of the treatment options available, not informing you of all of the risks and potential complications and poorly executed treatments or surgery. Read on to learn about ‘informed consent’.

The effects and consequences of negligent procedures can be permanent and life-changing – clients can experience a host of symptoms and difficulties and may require further surgery. Our experienced team of solicitors will be able to assess your case, identify grounds for negligence and advance your claim.

    • Severe scarring and disfiguration
    • Lack of information from the surgeon
    • Infections and allergies
    • Liposuction
    • Abdominoplasty
    • Facial surgery
    • Hair transplant claims
    • Gastric band claims

    What is Informed Consent?

Simply put, informed consent is where you are fully and comprehensively informed about your treatment, this should include (but may not be limited to):-

    • the necessity of the treatment
    • its suitability for you & potential alternatives
    • what your treatment entails – the process/potential further treatment
    • what to expect – not only in terms of results but comfortability levels/discomfort
    • cost transparency for the treatment in question and possible further treatment
    • what to expect
    • advice on the probability of its success/failure
    • problems that may arise/risks entailed
    • aftercare considerations

You should be advised if a particular procedure is perhaps beyond the experience or skill of your clinician and whether another professional is better suited to provide this.

The point of providing this information is so that you can make an informed decision on whether to undergo the procedure. You cannot provide consent if you have not been adequately informed about all the important factors relating to your procedure - hence why informed consent is vital legal prerequisite.

    COSMETIC SURGERY CLAIMS FAQ’S

Rhytidectomy surgery commonly known as a facelift, is an elective cosmetic procedure to address loose or sagging skin. It involves lifting and pulling back facial skin for a tighter and smoother appearance.

This kind of surgery is quite invasive and as with all surgical procedures a duty of care is owed. Unfortunately with the rise of cosmetic practices, many under-qualified practitioners advertise this procedure as non-invasive and straightforward – misleading patients, with disappointing results.

A range of problems and complications can arise, including nerve damage, unsightly scarring and hair loss. The post-operative cosmetic appearance can also give cause for concern, with patients being unhappy with how they look – a common complaint is asymmetrical facial features.

Lower Rhytidectomy surgery commonly known as a neck lift, is an elective cosmetic procedure that addresses visible signs of aging in the jawline and neck. It is often elected to treat excess fat and skin relaxation in the lower face that creates jowls, excess fatty deposits under the chin, loose neck skin and muscle banding in the neck - which creates abnormal contours.

This kind of surgery is quite invasive and as with all surgical procedures a duty of care is owed. Unfortunately with the rise of cosmetic practices, many under-qualified practitioners advertise this procedure as non-invasive and straightforward – misleading patients, with disappointing results.

A range of problems and complications can arise, including over-tightening of the skin, a pulled appearance of ‘pixie ear deformity’ and unsightly scarring. The post-operative cosmetic appearance can also give cause for concern, with patients being unhappy with how they look – a common complaint is asymmetrical facial features.

Liposuction or ‘lipo’ as it is often sometimes referred to by clients, is a surgical procedure that involves the removal of excess fat from specific areas of the body. The procedure is typically used to contour the abdomen, hips, thighs, buttocks and other areas where diet and exercise alone have not been been impactful. The aim is to achieve a slimmer and more proportional body shape.

Liposuction is a type of surgery that uses suction to remove fat from specific areas of the body, such as the stomach, hips, thighs, buttocks, arms or neck. Liposuction also shapes these areas.

There are different Kinds of Liposuction Procedures. Tumescent liposuction is the most common liposuction procedure. Ultrasound assisted liposuction uses ultrasonic energy. A metal rod is placed underneath the skin and emits this energy to liquefy your fat before removal. Vibration Amplification of Sound Energy at Resonance (VASER) is a type of UAL. This method utilises a grooved cannula and ultrasound waves to break up and remove both fat and fat cells.

Other types of Liposuction include, Suction assisted liposuction, Power Assisted Liposuction or PAL, Laser assisted liposuction also known as SmartLipo or SlimLipo.

A range of complications and problems can arise, including skin discoloration or changes in skin sensation, bruising, swelling or poor wound healing, pain or discomfort, scarring and bleeding. The post-operative cosmetic appearance can also give cause for concern, with patients being unhappy with how they look – a common complaint is contour deformity.

Blepharoplasty or eyelid surgery as it is commonly referred to by clients, is a surgical procedure to improve the appearance of the eyelids. Surgery can be performed on both the upper and lower lids.

The aim is to improve the appearance around the eye area, addressing loose or sagging skin – which may create folds or impact the natural contour of the upper eyelid. The procedure can also address fatty deposits or puffiness in the eyelids, bags under the eyes, drooping lids, excess skin and fine wrinkles.

Some patients undergo the procedure to correct functional problems with eyelids – the concerns detailed above can sometimes cause impaired vision.
A range of complications can arise with this procedure including bleeding, risk of infection, dry eyes, abnormal discolouration of the eyelids, scarring or an abnormal folding of the eyelid skin. Some clients have suffered with an inability or difficulty to fully close their eyes, a pulled-down lower lid lash line and in severe cases – a loss of vision.
